This is an appeal, by allowance, from a memorandum decision of the Superior Court which affirmed a judgment of sentence imposed by the Court of Common Pleas of Allegheny County. In a trial by jury conducted in 1990, the appellant, Monty Birch, was convicted of recklessly endangering another person. He was simultaneously acquitted of aggravated assault. A sentence of two years probation, two thousand dollar fine, and two hundred hours of community service was imposed. The conviction arose from an incident in which appellant shot an individual who attempted to steal his car. The factual background of the case is as follows.
