On June 17, 1993, following a seven day trial in the Court of Common Pleas of Philadelphia County (trial court), a jury found Miguel Rios (Appellant) guilty of first degree murder for the shooting death of Jose Ortiz. The jury also convicted Appellant of three counts each of robbery and unlawful restraint, two counts of aggravated assault, and one count each of burglary, criminal conspiracy and possession of an instrument of crime . The jury found three aggravating circumstances and one or more mitigating circumstances. Finding that the aggravating circumstances outweighed the mitigating circumstances, the jury set the penalty at death.
